2. Definitions

For the purposes of these terms, the following words have the meanings set out below, unless the context requires otherwise:

  • Website or Platform means TheGroupBuying.com and any pages, services, links, communication channels, or systems affiliated with it.
  • Company means AKMKA ENTERPRISES L.L.C, the operator of TheGroupBuying.com.

5. Priority of Offer Terms

7. Deal Activation

After activation, the product or service may be made available for purchase through the website, online store, or any other method approved by the platform.

The order confirmation period after activation varies by offer and may be 24 hours, 48 hours, 3 days, or any other period specified in the offer or notice.

If the user does not confirm the order, complete payment, or select the approved payment method within the specified period, the platform may cancel the user’s priority or make the quantity available to others without any additional obligation.

8. Failure to Reach the Required Number or Activate an Offer

If the required number is not reached or the offer conditions are not met for any reason, the platform may, at its sole discretion, choose not to activate the deal, extend it, modify it, relaunch it later, or cancel it.

The platform may, if it considers it appropriate, present an alternative price or alternative terms to interested users. The user is not bound by any new price or terms unless the user confirms the order under the new terms.

If the user has not paid any amount before activation, non-activation of the deal creates no financial obligation by the platform toward the user.

9. Prices and Fees

Prices are usually displayed in UAE dirhams unless another currency is stated in the offer.

The way a price is calculated may differ by offer. It may include or exclude tax, shipping, or other additional fees. This will be clarified, as far as possible, on the offer page or during checkout.

The user acknowledges that the special price in group deals may be conditional on a required number, period, quantity, or specific conditions.

The platform reserves the right to correct any obvious error in price, description, quantity, availability, offer period, or any published information, without any obligation to provide the product or service at the incorrect price or term.

If a material error is discovered after order confirmation, the platform may cancel the order, notify the user, refund any paid amount if payment was made, or offer an alternative option.

10. Payment

As a general rule in group deals, payment is made after the offer is activated and purchasing becomes available, unless a specific offer states otherwise.

Available payment methods may include:

  • Electronic payment through approved payment gateways.
  • Cash on delivery, if available for that offer or area.
  • Any other payment method approved by the platform.

The platform reserves the right to accept, reject, change, or suspend any payment method at any time, at its discretion and according to the offer nature, operational requirements, or fraud prevention needs.

The platform does not store full bank card details of users. Payment details are processed by approved third-party payment service providers according to their systems and policies.

If payment fails, is rejected, is reversed, or the order is not completed within the specified period, the platform may cancel or suspend the order or request an alternative payment method.

11. Cash on Delivery

If cash on delivery is available, it is an optional service and may not be available for all offers, areas, or users.

The platform reserves the right to restrict, cancel, or refuse cash on delivery for any user, order, or area without stating reasons.

If cash on delivery is selected, the user must provide a correct address and active phone number and respond to the shipping company or delivery team.

If the user refuses delivery without an acceptable reason, does not respond to calls, provides incorrect information, or repeatedly fails to receive orders, the platform may cancel the order, restrict the user’s use of cash on delivery, and/or claim shipping, re-shipping, or operational costs resulting from that conduct.

12. Invoices

An invoice may be issued in the name of AKMKA ENTERPRISES L.L.C if the company is the seller or order fulfiller.

An invoice may be issued in the name of the supplier or partner if that supplier or partner is the seller or fulfiller of the deal, depending on the offer nature.

The platform reserves the right to determine the invoicing mechanism according to the offer nature, fulfillment method, and operational and legal requirements.

The user must provide correct and complete information when requesting an invoice or completing an order.

13. Shipping and Delivery

Shipping and delivery terms vary by offer.

Delivery may be within the United Arab Emirates only, to specific areas, to other countries, or the offer may be digital or service-based and not require shipping.

Delivery times are estimates unless expressly stated otherwise in the offer.

The platform is not responsible for any delay or failure in delivery caused by incorrect information provided by the user, failure to respond, unavailability for delivery, delays by the supplier, shipping company, payment gateway, or any external party, or any circumstance outside the platform’s reasonable control.

Orders may be delivered in installments if required by the product nature, quantity, supplier, or shipping company.

The user bears any additional fees, re-shipping costs, storage fees, or extra delivery attempt costs if caused by the user’s error, failure, or lack of cooperation.

14. Cancellation After Order Confirmation

After order confirmation, payment, issuance of a purchase order, product preparation, or allocation of quantity, cancellation may not be available, especially for group deals, special-price offers, or products supplied based on a specific quantity.

Cancellation policies vary by product, service, or offer and will be stated on the offer page or during checkout when appropriate.

The platform reserves the right to reject a cancellation request if the order has been prepared, shipped, activated, allocated, or if the nature of the deal does not allow cancellation.

This does not affect any mandatory consumer rights that cannot be excluded under applicable laws.

15. Refunds, Replacements, and Returns

No refund or replacement request will be accepted if the issue results from misuse, improper installation, negligence, intentional damage, breach of use instructions, attempted fraud, or incorrect information.

Digital products, subscriptions, or services that have been activated, used, or delivered electronically may not be refundable unless the offer or applicable law states otherwise.

When a refund is due, it will be made to the original payment method or any suitable method approved by the platform. The time for the amount to arrive may vary depending on the bank, payment gateway, or payment method used.

16. Warranty

This does not affect any fixed financial rights of the user relating to a confirmed and paid order if such rights are due under law or the offer terms.

21. Prohibited Conduct and Misuse

26. Limitation of Liability

The platform uses reasonable efforts to provide an organized, clear, and secure service, but does not guarantee that the website or service will be free from errors, interruptions, delays, failures, or circumstances outside control.

To the maximum extent permitted by law, the platform is not liable for any indirect, incidental, consequential, moral, commercial, or profit-loss damages, or claims arising from use of the website, inability to use it, or reliance on its content.

27. Force Majeure and Circumstances Outside Control

The platform is not responsible for any delay or failure to perform if the cause is outside reasonable control, including without limitation:

  • Natural disasters.
  • Wars or disturbances.
  • Government decisions or regulatory restrictions.
  • Epidemics or emergencies.
  • Supplier delays or shortage of quantity.

  • Payment gateway failures.

In such cases, the platform may modify, postpone, cancel the offer, or refund any due amount according to the case, without assuming any additional liability.

28. Complaints and Amicable Resolution

31. Governing Law and Jurisdiction

If an amicable resolution cannot be reached, the courts of Dubai in the United Arab Emirates shall have jurisdiction over any dispute arising from the use of the website, these terms, or any transaction conducted through the platform, unless mandatory law provides for another jurisdiction.
